PMBs (BCHDs 95yr land lessor) MUST HAVE A PUBLIC VOTE UNDER Measure DD to Move Forward
PMB has 100% ownership of the property built on the PUBLIC LAND for 65 to 95 years under lease from BCHD. BCHD has 0% ownership, and in fact will pay PMB over $1.5M annually in rent for space for 91% to 95% non-resident use.
According to Measure DD, a public vote MUST OCCUR when an action occurs that "has the effect of converting any public land to private use"
THERE IS NO QUESTION - PMB IS A PRIVATE, FOR PROFIT COMPANY USING PUBLIC LAND FOR PRIVATE DEVELOPMENT/OWNERSHIP/OPERATION.
The City of Redondo Beach was faced with the same situation by RBUSD. RBUSD wanted to lease 3 acres of PUBLIC LAND to a PRIVATE COMPANY for PRIVATE USE. The City forced a vote because of the land use change.
MEASURE DD IS CLEAR - "the effective of converting PUBLIC land to PRIVATE use."
BCHD WAS specifically named as an agency that must comply IN THE MEASURE.
This is a litigation issue - plain and simple. The more BCHD or PMB spends before a public vote, the more likely they are to fail. Their choice.
